Electric bikes (e-bikes) are transforming how we commute and enjoy the outdoors across Idaho. Whether you are zipping through downtown Boise or navigating local pathways, the convenience of pedal-assist technology is undeniable. However, with the rising popularity of e-bikes comes a parallel increase in accidents and serious injuries.

As e-bikes become more prevalent on our roads and trails, it is essential for riders to understand the unique risks they face and how Idaho law handles liability when an accident occurs.

Common E-Bike Injuries

The combination of higher speeds, the heavier weight of e-bike frames, and the shared road environment with motor vehicles creates a recipe for significant trauma. Even with a helmet, e-bike accidents frequently result in:

In Idaho, not all e-bikes are treated the same under the law. Understanding your bike’s classification is critical for determining where you can ride and how liability is assessed in a crash:

  • Electric-Assisted Bicycles: If your e-bike has functioning pedals, a motor under 750 watts, and a maximum speed under 30 mph, it is generally regulated like a standard bicycle. You can typically use public roads, parks, and pathways.

  • Motorbikes/Motorcycles: Devices with foot pegs (no pedals), motors of 750+ watts, or potential speeds over 30 mph are classified as motorcycles. These require a motorcycle endorsement, registration, and insurance to be operated on public property.

Operating an e-bike that is actually a “motorcycle” without proper documentation—or allowing an unlicensed child to operate one—can create significant legal complications for you after an accident.

Navigating Liability and Claims

If you are injured in an e-bike accident, the legal path to recovery can be complex. Idaho uses a modified comparative negligence rule. This means you can pursue compensation for medical bills, lost wages, and pain and suffering as long as you are less than 50% at fault for the accident. If you are 50% or more at fault, you generally cannot recover damages.

Insurance companies often try to shift blame onto e-bike riders, arguing that the speed or weight of the bike contributed to the crash. To protect your claim, it is vital to:
