Data consistently indicates that children are the primary victims of severe dog attacks. Due to their height, curiosity, and limited ability to read an animal’s warning signs, children are uniquely vulnerable to facial and upper-body trauma.

  • Age Concentration: Children between the ages of 5 and 9 are statistically the most likely demographic to experience a dog bite injury requiring medical intervention.
  • Severity: Medical documentation shows that a significant percentage of pediatric dog bite injuries involve the head, neck, and face, frequently demanding reconstructive plastic surgery.

Currently, the average payout stands at over $58,500 per incident.

Understanding Liability: The Owner’s Responsibility

From a legal standpoint, accountability frequently lands on the owner or keeper of the animal. Depending on state statutes, liability frameworks typically fall into one of two categories:

  1. Strict Liability: In these jurisdictions, an owner is held fully legally responsible for injuries caused by their dog, regardless of whether the dog has ever shown aggressive behavior in the past or whether the owner was actively negligent. Washington State follows the strict liability rule.
  2. The “One-Bite” Rule: In other regions, an owner may only be held liable if they knew—or reasonably should have known—that their dog possessed dangerous or vicious propensities (e.g., if the dog had previously bitten someone or chased individuals aggressively). Idaho law generally takes the “One-Bite” Rule approach. However, there may be other paths for legal recourse depending on the facts of the case.
