Understanding Product Liability Claims in Idaho and Washington

Product liability claims generally fall into three recognized categories:
  • Design Defects: The overall design or blueprint of the product makes it unreasonably dangerous, even when manufactured exactly to specification. Courts often evaluate whether a practical, safer alternative design existed at the time of manufacture.
  • Manufacturing Defects: The product departs from its intended design specifications during the fabrication or assembly process, making a specific unit or batch defective compared to identical models.
  • Failure to Warn (Marketing Defects): The product lacks adequate instructions or safety warnings regarding non-obvious dangers and foreseeable risks associated with its operation.

Steps to Take Following a Product-Related Injury

Preserving evidence is critical in product liability matters:
  1. Retain the Product and Packaging: Keep the item in its post-incident condition. Do not discard, attempt to repair, modify, or return the product to the store or manufacturer.
  2. Preserve Documentation: Save sales receipts, user manuals, packaging, serial numbers, warranty cards, and maintenance records.
  3. Document the Incident: Photograph the product from multiple angles, photograph the scene, and capture visible injuries immediately following the event.
